These terms apply when a person (“Contributor”) sends an original audio recording (with an optional picture) or video with sound (“Recording”) to WORLD MADE MUSIC (“WMM”), operated by the person or entity identified above. By checking the relevant boxes and clicking “SEND MY SOUND”, the Contributor accepts this agreement.
1. WHO MAY CONTRIBUTE
The Contributor submitting this form must be at least 18 years old, legally able to enter into this agreement, and entitled to grant every right described below. The sound may be made by the adult Contributor or by their child, subject to Section 1A.
1A. RECORDINGS MADE BY CHILDREN
Where the Recording was made by a child under 18, the adult Contributor confirms that they are the child's parent or legal guardian, have the necessary legal authority to authorise the submission and all uses described in this agreement, and have obtained the child's agreement where required by applicable law and the child's maturity. Where consent of another holder of parental responsibility or another rights holder is required, the Contributor confirms that it has been obtained. The Contributor grants only rights that they are legally authorised to grant. WMM does not require the child's full name, date of birth or other identifying details. The public-credit choice refers to the adult Contributor, not the child. The child's mandatory personality, privacy and other rights remain unaffected. WMM may request further proof of authority or decline, restrict or remove a Recording involving a child. A parent or guardian can contact WMM to raise concerns or exercise applicable rights; no clause guarantees that a child's statutory rights can be waived or that every previously distributed use can be recalled.
2. YOUR RECORDING AND THIRD-PARTY RIGHTS
If an optional picture is included with an audio submission, it must show only original material created or controlled by the Contributor, without identifiable people or unauthorised third-party content. The picture is licensed to WMM for editing, display, publication, commercial use and sublicensing alongside or independently of the sound. The Contributor confirms that the Recording is their own recording and that they own or control all rights necessary for this agreement. Audio recordings must not contain copyrighted music, protected performances or recordings, or third-party voices without all necessary rights. VIDEO SUBMISSIONS HAVE STRICTER RULES: NO IDENTIFIABLE PEOPLE (INCLUDING THE CONTRIBUTOR OR THEIR CHILD), NO OTHER PEOPLE'S VOICES OR CONVERSATIONS, NO MUSIC PERFORMANCES, TV EXCERPTS, THIRD-PARTY MUSIC VIDEOS, SPEECHES OR OTHER UNAUTHORISED MATERIAL. Only original footage and sound created and controlled by the Contributor are allowed. Rights clearance alone does not override the no-identifiable-people rule for video. The Contributor is responsible for ensuring this. WMM may reject or remove any Recording.
3. LICENCE TO WORLD MADE MUSIC
The Contributor grants WMM a non-exclusive, worldwide, royalty-free, fully paid-up licence, for the duration of applicable rights and to the fullest extent permitted by law, to store, reproduce, edit, cut, sample, pitch-shift, transform, mix, combine, synchronize, perform, distribute, communicate, make available, publish and otherwise use the Recording or parts of it in any existing or future media and formats. This includes musical releases, videos, promotions, advertising, sound products and other commercial and non-commercial uses. For video, the licence also covers all submitted imagery, frames, motion and soundtrack, including synchronization, adaptation, cropping, silent reuse and use of audio extracted from the video.
Commercial sublicensing: The Contributor expressly authorizes WMM to licence or sublicense the Recording, extracts and adaptations to third parties, including for a fee. WMM may transfer this licence, including to a successor in the project. These rights are intended to continue without a time limit, subject to mandatory applicable law. Personal rights that cannot lawfully be assigned remain unaffected.
3A. VIDEO PROCESSING AND PUBLICATION
WMM may retain the original video with its soundtrack unchanged and create a separate audio file from that soundtrack. These two files remain subject to the licence and privacy conditions of this agreement. WMM may later remove or replace the video soundtrack when editing or producing its own works. No recording or video is automatically published; WMM reviews each submission manually and may reject or delete content that does not meet its editorial or rights requirements. Contributors must submit material that can lawfully be used worldwide, including commercially and by sublicensees.
4. VOLUNTARY CONTRIBUTION – NO PAYMENT
The Recording is contributed voluntarily and without financial consideration. The Contributor is not entitled to an upfront fee, royalties, licensing income, revenue sharing, other compensation or a share of proceeds received by WMM or any third party from use or sublicensing of the Recording.
5. OWNERSHIP, CREDIT AND EDITORIAL FREEDOM
As between the parties, the Contributor retains any ownership rights they already hold in the original Recording. WMM receives the licence set out above; ownership is not transferred by this agreement. WMM may decide freely whether, when, where and how a Recording is used, and is not obliged to use any Recording. Where the Contributor selects “YES” for public credit, WMM may mention the supplied name in connection with a use of the Recording, but is not required to credit each use. Where “NO” is selected, WMM will not intentionally publish the Contributor's name as a credit. Public credit does not create an entitlement to payment.
6. EDITING AND FUTURE WITHDRAWAL
The Contributor accepts creative editing and substantial transformation consistent with this agreement. The licence is intended to be irrevocable to the extent permitted by applicable law. However, mandatory statutory rights, including applicable personality and data-protection rights, remain unaffected. WMM may be unable to recall releases or licences already lawfully distributed before receiving a valid request.
7. CONTACT AND DATA
WMM processes Contributor information in connection with receiving, documenting and licensing Recordings as explained in the Privacy Notice. Submission receipts may document the chosen credit preference, acceptance time, agreement version and fingerprint of the Recording.
8. APPLICABLE LAW
The parties intend Swiss law to apply, subject to any mandatory laws and consumer or personal rights that cannot be excluded. If a clause is found invalid, the remaining clauses should continue to apply where legally possible.
Nothing in these terms excludes mandatory rights that cannot be waived under applicable law. For questions about a Recording or this agreement, contact sound@worldmademusic.com.
